Senator Rodney Ellis (D-Houston) today released the following statement regarding his decision to "tag" HJR 6, a constitutional amendment to ban same sex marriages in Texas:
"Issues like this stir the deepest passions in people and, unfortunately, there are some on the extreme fringes like the Aryan Brotherhood who feel emboldened and would rather bully than engage in the process. While everyone who favors HJR 6 is not a bigot, there clearly are those supporters who are and they are vocal. To them, I say this: I will not be bullied, threatened or intimidated, so stop trying."

The Aryan Brotherhood made a threat to Senator Ellis and it is currently under investigation by the DPS. Yes folks, when we told you it was about hate we were right. If you're still standing with HJR 6 you are standing shoulder to shoulder with the Aryan Nation. Good for you. At least they come right out and let us know they are full of hate and they don't hide behind the bible.
"This morning, I placed a tag on HJR 6 to ensure there will be adequate time to discuss this important constitutional amendment. House Joint Resolution 6 was added to today's State Affairs Committee agenda on Saturday. I am concerned that the late hour of that posting would prevent those Texans passionate about this issue from being able to get to the Capitol to testify on both sides of the matter. This decision will ensure that Texans will be able to get to Austin to participate in the debate and that the Texas Senate hears all viewpoints on this issue.
"The House Committee on State Affairs debated HJR 6 for nearly 13 hours. Clearly this is an issue which people from all across our state are wrestling with. Regardless on which side of the debate you stand, this is a very important and very volatile issue that deserves a full debate. I believe it just makes sense to ensure that everyone is given ample time to travel to Austin and have their voice heard.
"Let me be perfectly clear: I oppose HJR 6. It is unnecessary and doesnâ??t even do the one thing that its supporters claim it will do -- strengthen marriage. What two other people do with their lives has no bearing whatsoever on my marriage, just as my marriage has no bearing whatsoever on theirs. Last session, we passed the Defense of Marriage Act, a law which banned same sex marriage in Texas. What has changed so dramatically in two years? Yet, here we are saying this issue is such an immediate threat that we must amend the constitution. I wish the people fighting so hard for this issue would put half as much effort into correcting some of the problems plaguing our state instead of supporting divisive wedge issues that truly serve no purpose other than stoke the fires of discrimination.
"For those that are upset that this standard, often-used parliamentary maneuver means this amendment will not pass, I say: so be it. They may, however, want to ask the question as to why, if HJR 6 is such a top priority, it sat for 20 days, stone-like in the Senate State Affairs Committee without a sponsor or even a request for a hearing. I was born at night, but not last night; legislation that is a top priority does not go without a sponsor for 20 days. House Joint Resolution 6 passed the Texas House on April 26th; it was referred to the Senate State Affairs committee the next day; on Saturday, May 14th the resolution finally found a sponsor. If it could wait 20 days for a hearing, it can wait two days more.

It would be interesting to know more about you so I can better understand how you have arrived at some of your conclusions regarding the majority's "right" to "regulate" the minority. I hope you're not some kind of a control freak - that's a very sad way to live your life.
Now, about HJR 6 - you're right, it's a stupid, pointless waste of time. I wish all the time that was dedicated to this issue had instead been invested in resolving our state's educational issues and/or problems with CHIP and/or problems with CPS. HJR 6 was introduced in the House by someone whose education on the subject of homosexuality appears to be extremely limited for whatever reason. To be fair, I would guess, based on what little I know about that legislator, his lack of knowledge in this area is likely because of his experiences in life and his educational background. I personally don't think it's right for someone from the Panhandle who doesn't know how to research an issue properly (regardless of his "beliefs") to inflict legislation that is fear-driven or hate-driven or ignorance-driven or control-freak-driven or etc. on the rest of us, particularly when it has the potential to waste MY tax money by eventually being absorbed into the judicial system due to a legal challenge (where, my knowledge and experience suggests, it would most likely be overturned). Of course, it WAS passed by a majority of the inhabitants of the House, which leads to...
It seems to me that this edition of the Legislature contains a lot of people whose primary motivation for public service is to see how much of other people's business they can mind, no matter what it might cost in terms of tax money. I don't think that's what the Legislature should be about, but my conclusion, flawed though it may be, is that's exactly what the majority of Texans who voted (which is a different number than the majority of Texans) thought. I guess that means my opinion is worthless because I'm in the minority.

I have always liked and respected Senator Ellis. Now I think I just flat out love the man.
Lost in the HJR 6 discussion is this: gay marriage is good for society.
It's in our interest to have people living in stable households. We don't get to decide whether there are gay marriages; there are, whether the law recognizes them or not.
What we get to decide is if it's better for society if, for example, someone's same-sex spouse loses her health insurance after getting laid off & then gets a major illness, if we're better off if she was able to get onto her partner's health insurance, or if instead her illness brings financial ruin on the household.
We get to decide if there should be an orderly split of property and custody of any children when same-sex couples split up, or if it is better for the community and the kids to have a nasty court battle in uncharted territory.
We get to decide if we want to enourage families to stay intact, or make it way too easy for them to split up.
We don't get to decide what families will exist; people will live their lives, regardless of whether the law recognizes them or not. They have for generations and they will continue to.
HJR 6 is about stigmatizing people because certain people don't like them, and want their judgment made law, at the expense of individuals and the community as a whole. That's all.

I've posted the following trivia on a few blogs, but I think it drives home the points that majorities oppose the exercise of some fundamental rights long after that right is properly recognized, that is bigotry dies very hard:
In 1958, the US Supreme Court was met with a case of a miscegenation law from Virginia which prohibited marriages between a black and a white. The Court punted on the issue without really considering the merits of the case, but it prompted the Gallup polling organization to ask the question, albeit only to white, do you approve or disapprove of interracial marriage. At the time, such marriage were illegal in around twenty something states, with atleast 30 states having them in 1948. The results showed 94% of white Americans disapproving of such marriages and only 4% approving. Nine years later in 1967, the Supreme Court struck down the miscegenation laws of the 15 states that remained the last holdouts (predictably all in the South). The following year, Gallup asked the question again, this time of a representative sample, and 72% of Americans disapproved of interracial marriage, a year after they became legal nationwide. The trivia question is this: In what year in Gallup polling did approval of interracial marriage finally outpace disapproval? Was it...

C) 1981

Ummm... we don't let the RIGHTS of a minority be determined by tyranny of the majority in our system of government. The American system is a DEMOCRATIC REPUBLIC, it is *not* a direct democracy -- that's something you should've learned in eight grade civics class, Paul.
A perfect example of why this is necessary is from Alabama just LAST YEAR. That state's consitution is full of old segregation-era laws that are unenforceable because of federal civil rights era legislation and court decisions affirming the rights of the minority. However, in November of LAST YEAR, the Alabama legislature tried to pass a constitutional amendment to remove language about segrated schools. GUESS WHAT? The MAJORITY of VOTERS in Alabama voted to KEEP that bigoted language in the state constitution. Thank God we don't live in a direct democracy.

Let's get back on-topic, people. Ahem.
The point is, Paul, that oftentimes the majority is wrong. I know, it's incredibly hard to believe, but it is true. That's why we live in a democratic republic, so that we could have learned men govern for us. That is very different from having ignorant men rule us and make decisions like who we can and cannot marry for us.
That is what a lot of amendments and bills this session have been about. The muni wireless telecom bill, HJR 6, HB1476, all were about other people making decisions for us or which special interest should have exclusive market rights to us. That is the very antithesis of a free and democratic society.
And make no mistake, HJR 6 is about legislating hate. You can try to wrap it up in religion or the flag or talk about what is best for society, but at the end of the day it is one group telling another group they don't deserve to have all the rights a citizen of this country is entitled to. That is just wrong. In any decent human being, it is morally indefensible.
Nazis today don't wear brown shirts and little armbands; they wear three-piece suits and talk about what is best for society.
Answer to the trivia question in what year in Gallup polling did approval of interracial marriage finally outpace disapproval is E) 1991. Some 24 years, a full generation, after the Loving decision a plurality of Americans finally approved of interracial marriage. I say plurality since the approval was only at 48% with disapproval at 42%.
As has been pointed out repeatedly, the majority can oft be wrong and just because something is favored by the majority doesn't make it right. Such is the rule of a mob that what one day carried a majority, the next can be cast to the wayside. And that certainly isn't even a new observation given the Greek General Thucydides wrote about it in his History of the Peloponnesian War in reference to the punishment of the city of Mytilene for its revolt against Athens. Support and opposition to same-sex marriage are in flux and what is needed is more discussion, not a measure to stop all debate on the matter, which is what that bigotted inf from Pampa is trying to do. And bless Rodney Ellis for trying to keep open debate on the matter alive.
And, to pile on, the voters of Alabama recently voted to KEEP IN all their segregation language.

Folks, we don't live in a Democratic Republic. We live in a CONSTITUTIONAL REPUBLIC! I don't know what government classes you attended. This is a relevant point.
Our Federal constitution was devised with the intent that the majority would rule, but be held in check from terrorizing the minority by a set of rights that were inalienable (in other words, not able to be taken away). It is this matter that has us in crisis. Extremist bigots, calling themselves Christians and patriots, are attempting to erode the constitution by removing some of those 'inalienable rights' from the list. The 'all men are created equal' phrase in that great document has been challenged many times - by those who felt that women were not equal to men, by those who felt that blacks were not equal to whites, and now by those who feel that homosexuals are not equal to heterosexuals.
You can wrap it in whatever cloak you choose, but it's bigotry, plain and simple, and has nothing to do with Christian values. The last time I checked, the word Christian meant 'follower of Christ'. Please provide a quote from Christ that condemned homosexuality. You can't. If it were that important to our morality, I believe that He might have referred to it at least once, and that His followers would have written it down.
There is no debate for this amendment that can be justified, morally or logically. I've yet to hear any merits identified in this blog.
